Ok here it is

I am 100% Livid right now. I am thinking of writing an official letter of complaint and or going to the papers with this one. I know if you are in the same situation as me this is going to make you too see red.

As you know I have PND part of this I get panic attacks and I am often scared to go out side my front door. Due to the anti social behaviour in my street I am not getting much sleep and we are overcrowded. My CPN has written a letter to the council stating that she feels that my PND will not get any better unless I am moved to a bigger property.

WAIT FOR IT north Lanarkshire council  have told me that Mental health IE depression is not recognised as a health need they will only see Physical disability as a disability and there for I will just have to wait on the same list. They told me that I could have a house in this street ( it is full of anti social people). I then told them that my depression is exacerbated with the anti social problem I have the now and my CPN states this in her letter. I was told well it could be 5monthes or years before I get moved.

I have been looking at legislations and the human right policy and I found this,

Antisocial Behaviour etc (Scotland) Act 2004

For many of the groups of people described in the following chapters, including people with mental health problems, one source of disadvantage is fear of harm or abuse ( DRC/Capability Scotland, 2004; Mind, 2004). Although not specific to these groups of people one indirect source of protection may come from the Antisocial Behaviour etc. (Scotland) Act 2004. Under this piece of legislation local authorities, together with the relevant Chief Constable, are required to prepare a strategy for dealing with anti-social behaviour in the Council area. The strategy will set out the nature of anti-social behaviour in the area, the services available for preventing and tackling this behaviour, including for victims, and new services required to fill gaps in provision (Scottish Executive, 2004g). For the purposes of the Act, someone who acts or pursues a course of conduct that causes or is likely to cause alarm or distress is engaging in antisocial behaviour (section 143).

What do you think do I have a leg to stand on? I don’t think I am special and I should jump the queue but I think honestly if I need to stay hear much longer I will relive my family of the overcrowding and just jump out the window that’s how bad life is the know. Sorry its long x

I don't understand that. I was under the impression that depression etc was a recognised diability. I have been moved out of bad housing before due to my depression being aggravated.

Have you thought about contacting your local MP ?

Write to your MP and back to the council, threaten to copy it to all local and national press unless it is dealt with. Speak to your CPN again and see if she can do anything.

You do have a case here so push for it and you'l be ok.

I really don’t have the energy any more to fight. Also I don’t have any confidence in my abilities to make any sort of different the way I feel about myself is I am really insignificant. Also I think the problem is my DH is part of the communities council he volunteers his time and I am also in the local gala committee I think this is working agents us as it may look as if its favouritism. I don’t know this for sure tho. Our local MP died recently before he did he did all e could for us on this issue and our new MP is calling every other week to see what is happening but still we all face brick walls

Mazwalker i was hoping you wold respond do you really think it would work ?

Yes I do.

Your depression is a severe form. Resulting in agrophobia and panic attacks. I would recommend asking your GP or CPN for a mental health evaluation which will show the extent of your problem.

Unfortunately the symptoms of depression make fighting a battle like this really difficult. I understand how you feel as my depression used to bring on panic attacks. But actually this could be just the thing you need to help you. Sometimes a good fight about something you believe in can actually improve your mental health. (trust me I'm living proof!)

I wouldnt worry at all about favoritism. Use your connections! Is your DP being supportive on this. I think he could really help too! Sit down and discuss a game plan with him.

Some more info for you on government guidlines about what justifies disability in mental health can be found here Give me a shout if I can help anymore!

(Oh and the papers will have a field day with it! So get writting to them!)

Edit: Just had another thought - try contacting the depression alliance www.depressionalliance.org and other depression charitys - I'm sure they'd be willing to help!

I wish I was a bit closer and I would come and help you. You need a bigger house in a different area to help you get better, surely someone must see that. It is not favouritism it is something you are entitled to.

Please don't give up. You appear to have the support of your MP. Have you tried your MSP as well and the papers.

Sending you massive hugs and good luck wishes xxxxxx

I am so angry on your behalf. It's an absolute disgrace that they are not recognising your PND as reason for move. Please don't give up - I also suffered from PND and panic attacks - totally understand why you don't want to have to deal with this. It would be hard enough to deal with anyway, without PND. Def take Madzwalker's advice - use any connections you have, and contact papers if you have no success. Best of Luck xxx

For goodness sakes - that is awful for you. I don't want to give you the wrong advice, but I would certainly be making them aware that I was going to the papers if I was in your position.

They cannot leave you living in a house where you are too frightened to sit in your own livingroom at night. Have you taken any advice from your local police about the fact people are "harrassing " you in your own home like that?xxx
