DH and I were discussing this last night.
When we saw Sylar meeting Dr Suresh senior, Dr S told him that the special abilities were found in the brain. So I think Sylar eats the brain (or part of it) and gains the ability. The ability is only found in the brain once the ability has appeared, but you can find the genetic markers in the people's DNA before the ability manifests.
Thats what I think anyway. That said, some of the Heroes forums say that Sylar's ability is that he can alter his own DNA to get the abilities from others. I'm not sure about that as otherwise, why would he have to get to their brains?!

They did say on one of the behind the scenes shows, that it hadnt been established what he did with the brains once he had cut the head open!!! and to be quite honest, I for one dont want that question answered!!!
