I purchased some Croc Yukon's off ebay they came from a supplier in the US as they are not really available in the UK yet, the size was advertised in a UK auction as size 12, US size 13 which is my size, they eventually arrived yesterday after 4 weeks and they have sent US size 12 which is UK size 11 , I've yet to receive a reply from the supplier but it is the weekend so there is nothing unusual there but what are my rights? Who covers the return postage costs to the US, it is after all their mistake.

I think you will have to pay the postage to return the item back at first, but im sure the seller should offer to reimburse your postage paid, as it was their mistake sending out the wrong size. I've tryed looking on Ebay, to see if there's any advice on there, but i cant find nothing yet. There is an advice centre on there though, you could post, and see if anyone can answer your question? Sorry, not much help but i hope you get the right size, without being out of pocket! By the way, 4 weeks seems a long time to wait for something from abroad.. is that amount of time normal or is that taking the mickey too.. just curious.

I had once to return a faulty dvd recorder but this was to an individual seller not a business.
If they are a registered business you have much more rights.
The CAB has a website adviceguide.org.uk which is useful at times.
In my case I had to pay for the return postage which needed to be signed for on receipt, in your case Airsure which is about £3.60 on top of the Airmail price!
I did however get the rest of my money back via Paypal, ie the full price I paid including postage although I "lost" the return postage.
I also returned a scratched cd on one occasion & the seller was kind enough to refund the full amount & then send an additional separate payment to me for the posatge.

If you get no joy, are you entitled to ring the Ebay Hotline? I had to speak to Paypal over the dvd recorder fiasco but fortunately I found them very helpful, I cannot find their phone number now though, sorry.

i had a problem oncw with some prada flip flops - they came and they were fake as hell (take in2 account i paid £100 for these) i sent them back and paid the postage but fair-play the seller refunded all my costs back, if they are a good seller they will refund as they wouldnt want bad feedback - goodluck jue xx

I had 2 problems recently with sellers sending the wrong item (would you believe 2 sellers, 1 week, 2 wrong items arghh!!) anyway, one of the sellers reinburst my postage posts into my paypal account straight away, asked me to send the item back and quickly dispatched the correct item. The other seller was lovely, asked me to return the item, very good communication, promised me postage costs for returning it, but I never received it. I did get the correct item quickly, but never seen any postage refunds! I didn't chase it up as it was only a small value, but I'd have thought the US seller was liable fopr covering the return postage. You may want to get it before you send them back though!

Hiya,
ok.. mumofone is right, you do have rights when buying especially from a registered business (distance selling regulations etc) howver, as the seller was registered the US, they do not have to coply with UK/Euro laws.
What you can do however, is file a dispute through paypal. They will immediately contact the seller and ask them to respond to your dispute and whilst they are waiting on them to do so, they place a freeze on your money so that the seller can't withdraw it from there account. You have 20 days to sort it amicably between yourselves and at any point during that time you can escalate and ask paypal to intervine. Paypal would then take over and decide whether a refund is due and of how much. If at the end of thw 20 days neither of you has escalated it, then the file is closed and paypal takes nothing else to do with it.
Your best bet would be to file the dispute and wait to see if they respond. If you keep everything through paypal it makes it easier for them to make a decision. If they decide in your favour, they will ask you to retunr the item and provide them with tracking information. Once that's done, they'll then refund your money, usually in full (but don;t quote me on it). If they're a reasonable seller, they'll refund you the return postage but as it's the states you might have a fight on your hands due to the expense (and the fact that they would then have to pay to send another pair over to you)..
What are they like? what colour are they? do you want to post a picture as I might just buy them off you as my little one is an 11 and it would save you a lot of hassle..

They are an adults size 11 (US size 12) not a childs not sure if you are aware of that?
They are nice crocs and I guess as they are yet to be released in the UK they will sell on Ebay and I should have no trouble getting my money back but I still want a pair that fits me

Sold them for the same price as I purchased them for, including the postage costs from the US. so I did not lose out and the original trader sent me another pair in the correct size this time postage free and they arrived this morning and they fit!
